Delegation of Authority
What is delegated authority?
Under the Local Government Act 1993, Council may delegate a function to a person or group of people (i.e. Community Operating Committee or Incorporated Association). Your delegated authority allows you to perform the activities prescribed within the delegation, on behalf of Council.
The delegation not only gives members of the community the power to make decisions relating to a particular facility, but also provides insurance coverage, procedures, guidelines, equipment, and training, to ensure that you operate in a safe working environment.
Formal appointment of delegates
Council appoints delegates on an annual basis by letter containing the delegation arrangements and timeframes. Council delegations are to individuals who together make up an Operating Committee to jointly manage activities on the land, or to an Incorporated Club or Association which manages the land.
The formal appointment of individual representatives of the Incorporated Club is necessary, even when the body managing the public land is an Incorporated Club or Association. Individuals from incorporated clubs/ associations put forward to Council as delegates must hold positions on the executive, in order to carry out their obligations as Council delegates.
An Incorporated Club or Association must notify Council immediately should the status of the Incorporated Body or the Membership of the Executive change. Council has the authority to remove delegation at any time. If you require further information on your delegated authority, please contact your Council Management Officer.
